THE NEW GERMAN LAW

On March 1, 2020, a new Law on Facilitating Employment Procedures

for Professionals from Non-EU Countries came into force in Germany. It radically changes the position of foreign personnel with vocational education and dergees both.

 The main innovation is that representatives of working specialties will also be able to get a job in Germany, as well as university graduates. Previously, those who graduated from college or technical school could get a job only if the profession was on the list of scarce personnel. Now this restriction is cancelled, but there are a few conditions left:

Qualification – the applicant must have a university diploma or a vocational training diploma of the educational process that lasted at least two years. This qualification must be confirmed by the German specialized agency (we will consult you and determine your chances).

Contract – you must have a specific job offer with a German employer / work contract signed by both sides. Once an employer is found, we submit an application for an expedited procedure for skilled workers to the State office for immigration. The state office for immigration consults us and your employer and supports us in applying for the recognition of your qualifications obtained outside Germany. It also receives approval from the Federal Employment Agency. The diploma recognition agencies and the Federal Employment Agency must make a decision within a certain time frame. The state fee of the Office for immigration for this procedure is 411 euros per applicant. A diploma recognition fee must be paid additionally (calculated individually).

If all the requirements that can be checked in Germany are met, the State office for immigration issues a so-called prior authorization, which your employer sends you. Once you have received prior authorization, you can book a date and time at the overseas mission (embassy) for your visa application, which must be issued to you within three weeks. When applying, you must provide the original prior authorization along with additional documents (a list will be provided to you). The visa fee for the embassy is 75 euros.

An important condition is that the qualification must be recognized in Germany. You can apply for the examination of documents and the diploma recognition being in your native country. We will do it for you.
